Terms & Conditions

These Terms and Conditions (hereinafter "T&C") govern the use of the Finer platform, operated by FINER APPS SRL, a company registered in Romania under CUI 49982161, Trade Registry No. J03/968/2024, EUID ROONRC.J3/968/2024.

By accessing and using the platform, you confirm that you have read, understood and accepted these terms in their entirety.

• Platform: the Finer web and mobile application, including all associated features and services
• User: any natural or legal person who accesses or uses the Platform
• Restaurant Client: a user who owns or manages a restaurant and uses Finer services for digital management
• End Client: a person who interacts with digital menus, reservations or events through the Platform
• Account: the User's personal space on the Platform, accessed through unique credentials
• Services: the features offered through the Platform, including digital menus, reservation management, events and restaurant profile

Finer offers the following services through the Platform:

• Digital Menu: creating, editing and publishing digital menus with QR codes, nutritional values and augmented reality
• Reservation Management: automating the reservation process, automatic confirmations, table planning and deposit options
• Events: creating and managing events, ticketing, digital check-in and virtual wallet
• Restaurant Profile: dedicated restaurant page with complete information, offers and promotion on the Finer City platform

We reserve the right to modify, add or remove Platform features, with prior notification to users.

To use the Platform services, creating an account is required. Upon registration, you agree to:

• Provide correct, complete and up-to-date information
• Maintain the confidentiality of your access credentials
• Immediately notify Finer of any unauthorized use of your account
• Not transfer the account to other persons without our written consent

We reserve the right to suspend or close accounts that violate these terms.

As a Platform user, you agree to:

• Use the Platform in accordance with applicable laws and these T&C
• Not upload illegal, offensive content or content that infringes third-party rights
• Ensure the accuracy of menu information, prices and allergens
• Comply with ANPC regulations regarding consumer information
• Not attempt to gain unauthorized access to Platform systems or data
• Not use the Platform for fraudulent activities or spam

Finer services are offered on a subscription basis. Specific payment conditions include:

• Prices are displayed in RON and include VAT where applicable
• Billing is done monthly or annually, according to the chosen plan
• Payments are processed through authorized payment processors
• Late payment may result in suspension of access to services
• Refunds are granted according to the current refund policy

All intellectual property rights to the Platform, including but not limited to design, source code, logos, trademarks and original content, belong to FINER APPS SRL.

Users retain rights to content uploaded to the Platform (menus, images, descriptions). By uploading content, you grant Finer a non-exclusive license to display and distribute this content for the purpose of providing services.

Finer makes reasonable efforts to ensure the continuous and correct operation of the Platform. However:

• The Platform is provided "as is" and "as available"
• We do not guarantee uninterrupted operation or the absence of errors
• We are not responsible for indirect losses, loss of profit or consequential damages
• Our total liability is limited to the subscription value paid in the last 12 months

These limitations do not affect consumer rights provided by applicable law.

The account can be terminated:

• By the user: at any time, by request at contact@finer.business or from account settings
• By Finer: in case of violation of these T&C, with 15 days prior notice
• Automatically: after a period of inactivity of 24 months

Upon termination, account data will be deleted according to the privacy policy, except for data we are legally obligated to retain.

We reserve the right to modify these T&C. Significant changes will be notified at least 30 days before they take effect through:

• Email to the address associated with the account
• Notification within the Platform

Continued use of the Platform after changes take effect constitutes acceptance of those changes.

These T&C are governed by Romanian law. Any dispute will be resolved by the competent courts in Romania.

If any provision of these T&C is declared null or unenforceable, the remaining provisions remain valid.
